How the Hearing Process Works

​

1. Filing a Complaint: A written due process complaint is filed with the school district and a copy submitted to the NYSED or, in NYC, the Office of Impartial Hearings. The complaint must clearly describe the problem and propose a resolution.

2. Resolution Period: The district has 15 days to hold a Resolution Session, unless both parties agree to waive it. This step may resolve the matter without proceeding to hearing.

3. Impartial Hearing: If unresolved, the case moves to a hearing before an Impartial Hearing Officer (IHO)—a licensed attorney trained and appointed by NYSED. These hearings resemble trials but are less formal. Evidence is submitted, witnesses testify, and legal arguments are made.

4. Decision: The IHO issues a written decision, typically within 45 days after the resolution period ends (subject to extensions). Decisions may include:

  • Changes to a student’s IEP

  • Orders for specific services or placements

  • Awards for compensatory services

  • Tuition reimbursement for unilateral private school placement

5. Appeals: Either party may appeal an IHO decision to the State Review Officer (SRO) within 40 calendar days. SRO decisions can subsequently be appealed in court.

 

Special Considerations in New York City

 

  New York City handles the largest volume of impartial hearings in the country. As a result:

  • Significant delays in IHO assignments and decision issuance have been documented.

  • A 2021 federal court order mandated comprehensive reform of the system.

  • The NYC Office of Impartial Hearings continues to evolve in response to these legal mandates.
