  A protest is a formal, notarized statement that a negotiable instrument—such as a check, promissory note, or bill of exchange—has been presented for payment or acceptance and refused. This document, prepared and executed by a notary public, serves as legal evidence of dishonor, supporting your claim or litigation against the parties liable on the instrument.

 

Negotiable Instruments Subject to Protest in New York

 

  Under New York Negotiable Instruments Law and UCC Article 3, the following negotiable instruments may be lawfully protested by a notary public:

 

  Bills of Exchange:  Common in commercial and international transactions, a bill of exchange is an unconditional written order to pay a specific sum. If dishonored upon presentation, we can issue a formal protest to secure your rights of recourse.
